Terms of service
Last updated November 1, 2026
These terms cover the TrimPolar Polar, phone app, owner portal, cloud service and this website (together, “TrimPolar”). By creating an account or using a Polar you agree to them. Our privacy policy explains how we handle your data.
Not a navigation aid
TrimPolar shows performance information: targets, polars and the readings your instruments send. It is not a navigation, collision-avoidance or safety system and must not be relied on for those. Readings can be late, wrong or missing. The skipper is always responsible for the safe handling of the boat, and for keeping a proper watch and using approved charts and instruments.
Test program
TrimPolar is pre-release. During the test program, features may change, stop working or be removed, and data may occasionally be lost. Please keep your own records of anything important. Applying for a test box commits you to nothing, and we may not be able to offer one to everyone who applies.
The terms of your test box (whether there is a price, whether you keep it or return it, and what feedback we ask for) are set out in your invitation and order. Where they differ from these terms, the invitation and order apply.
Your account
- Give accurate details and keep your password to yourself. You are responsible for activity on your account.
- You must be at least 13, and old enough to agree to these terms where you live.
- The owner of a boat’s team decides who joins it and what they can see. Only invite people you trust with your boat’s data.
- Tell us straight away if you think someone else has used your account.
Fitting the Polar
Fit the Polar as the instructions describe, or have it fitted by someone qualified. Do not modify it, open its case, or connect it in a way that could affect your boat’s electrical system or instruments. We are not responsible for damage caused by fitting it differently from our instructions.
Your data
Your boat’s data is yours. You give us permission to store, process and display it to run TrimPolar for you and the people you share it with. You can also let us use it, with your boat name, crew and position removed, to improve TrimPolar and its polar models. That permission ends when the data is deleted, except for results already built from data that no longer identifies anyone. See Your data.
Acceptable use
Do not:
- use TrimPolar to track a boat or person without their permission;
- try to get into accounts, boats or Polars that are not yours, or to bypass our security;
- upload anything unlawful or that you have no right to share;
- overload, disrupt, copy or reverse engineer the service, except where the law allows it.
We may suspend or close an account that breaks these rules, and will tell you why unless the law prevents it.
Our software and brand
We own TrimPolar’s software, designs and name. We give you a personal, non-transferable right to use the app, portal and the software on your Polar while you have an account. Third-party brands named on this site belong to their owners.
Warranty and liability
During the test program TrimPolar is provided “as is”. As far as the law allows, we make no promise that it will be uninterrupted, error-free or fit for a particular purpose, and we are not liable for indirect or consequential loss, including lost races, lost data or damage to your boat, arising from using TrimPolar. Where we are liable, our total liability is limited to the amount you paid us in the twelve months before the claim. Nothing in these terms limits rights you have as a consumer that cannot be limited by agreement.
Ending your account
You can stop using TrimPolar and delete your account at any time. We may end the service or the test program with reasonable notice, and if we do we will give you a way to get a copy of your data first.
Changes and law
We may update these terms. We will change the date above and tell you of significant changes in the app or by email before they apply; continuing to use TrimPolar after that means you accept them. These terms are governed by the laws of Nova Scotia and the federal laws of Canada that apply there.
